I’m currently 16 years old, and will turn 17 at the end of next month. I lived with my mother and her finace, and my mother just passed. My real father is also calling, intending to throw in a bunch of legal technicallity stuff. Can I choose where I want to go? Could my father just come by and pick me up? My wishes are to continue to live with my stepdad, as he has been with my mom and i for many years. My mom had sole custody of me, although myfather was allowed visitation rights. Could he just come and pick me up, not questions asked, even if my wishes were to stay with my stepdad? On top of this all, i am pregnant. What would my father be able to do as of now? I have yet to talk to him, and have yet to disclose to him the fact that I am pregnant. Could he just pick me up without going to court? If it did go to court, would the court allow me to make my decision of where i wanted to stay? Thanks.

Answer by Greg In most areas the judge will consider where the child wants to live at the age of 12. That doesn’t mean it’s completely up to the child though. The judge will look at the entire picture.
